Terms of Service
1. The agreement
These terms are between Paydesk Limited, operator of Teleeza POS ("we", "us"), and the business that opens an account ("you"). By creating an account or using the website, the Android app or the computer app, you accept them. If you are accepting on behalf of a business, you confirm you are authorised to do so.
2. The service
Teleeza POS is point-of-sale and business management software: selling at a till, stock, customers, suppliers, staff, reports and M-Pesa collection. We provide it as a service over the internet; you do not receive a copy of the software.
We may add, change or remove features. Where a change materially reduces what you get, we will tell you in advance.
3. Your account
- You must give accurate details and keep them current.
- You are responsible for everything done under your account, including by your staff.
- Keep passwords secret. Tell us at once if you think an account has been compromised.
- You decide which of your staff get which permissions, and you are responsible for that choice.
- One account is for one business. Do not resell or share access outside your business.
4. Trial, price and payment
- New accounts get a free trial. The length is shown when you sign up and may change for future sign-ups.
- After the trial the service costs KES 550 per month per business, payable in advance by M-Pesa. There is no card requirement and no automatic charge — you choose when to renew.
- SMS credits are bought separately at KES 1.00 per SMS of up to 160 characters (spaces included); a longer message is charged as 2, 3 or more SMS.
- If a subscription lapses, selling is paused until you renew. Your data is not deleted — you keep access to billing so you can restore service.
- We may change prices. A change never affects a period you have already paid for, and we will give notice before it applies to your next renewal.
- Payments to us are non-refundable except where Kenyan law requires otherwise.
5. M-Pesa payments
This is the part most worth reading carefully.
- When your customer pays you by M-Pesa through Teleeza POS, the money goes directly from them to your own till or paybill. It does not pass through us and we never hold it.
- We send the payment request and record the result. Whether a payment succeeds, and when it settles, is determined by Safaricom, not by us.
- You are responsible for the till or paybill number you enter. We cannot recover money sent to a number you entered incorrectly.
- The only money that reaches us is what you pay us: your subscription and SMS credits.
- You remain responsible for your own tax obligations, receipts and records.
6. Your data
- Your business records remain yours. We claim no ownership of them.
- We hold and process them to run the service, as described in our Privacy Policy.
- You can export your data from the app at any time — sales, stock movements, statements and customer records.
- You are responsible for the lawfulness of the personal data you record about your own customers, including telling them what you collect and why.
7. Acceptable use
Do not use Teleeza POS to break the law, to send unsolicited bulk messages, to store data you have no right to hold, to attempt to access another business's data, to probe or overload our systems, or to resell the service as your own.
We may suspend an account that does any of these, or that puts the service or other users at risk. Where it is safe to do so we will tell you first.
8. Availability
We work to keep Teleeza POS running at all times but do not promise uninterrupted service. Maintenance, faults, and failures at Safaricom, our hosting or network providers can all interrupt it. Offline cash sales keep working on the device and sync when the connection returns.
9. Our liability
- The service is provided as is. We do not warrant that it is error-free or fits a particular purpose beyond what these terms describe.
- We are not liable for indirect or consequential loss, lost profits, lost sales or lost data beyond our control.
- Where we are liable, our total liability in any 12-month period is limited to what you paid us in that period.
- Nothing here excludes liability that cannot be excluded under Kenyan law, including for fraud or death or personal injury caused by negligence.
10. Ending the agreement
- You may stop at any time by not renewing, or delete your account from the deletion page or in the app.
- We may end it if you break these terms, or on 30 days' notice for any other reason.
- On closure, data is handled as described in the Privacy Policy. Export anything you want to keep first.
11. General
These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction. If any part is found unenforceable, the rest stands. We may update these terms; we will tell account holders in the app and by email when a change is significant, and the date below will change.
